Miny's Mexican Restaurant's failure to act with respect to a breach by you or others does not waive its right to act with respect to subsequent or similar breaches. These Terms set forth the entire understanding and agreement between you and Miny's Mexican Restaurant with respect to the Site.

9. Payments

Miny's Mexican Restaurant accepts payments via valid Credit Card, Apple Pay, CashApp, Google Pay. All payments and credit card information are securely processed and managed by Square Payments.

10. Service Charges

An online service charge will be added to all orders placed through our website. This charge helps cover operational costs and ensures we can continue providing quality service. The service charge is not a gratuity and is not distributed to staff members. Additional gratuity is at the discretion of the customer.

11. Delivery Services

Miny's Mexican Restaurant offers delivery services through DoorDash. Your order is fulfilled by DoorDash Dashers. Delivery times are not guaranteed and may be delayed due to driver availability.

Occasionally, a driver may not be immediately assigned to your order due to:

• A lack of available Dashers in the area
• High order volume at the time
• Weather conditions or traffic delays

Delivery orders are subject to DoorDash's terms and conditions, delivery fees, and service availability. We are not responsible for any issues that may arise during the delivery process, as these are managed by DoorDash.

Order Cancellation Policy: If you need to cancel your order, we can cancel the delivery service, but the food order cannot be cancelled once preparation has begun. In such cases, you'll need to pick up your order from the restaurant.

12. Refunds

We offer refunds for orders placed the same day only, and refunds will be issued to the same payment method.

13. Ordering Policies

All orders must be placed at least 30 minutes before closing time. We reserve the right to refuse service to anyone. Special requests and modifications to menu items may not always be possible and are subject to kitchen availability.

14. Dietary Restrictions & Allergens

While we strive to accommodate dietary restrictions and allergies, we cannot guarantee that our food is completely free of allergens. Our kitchen handles various ingredients including nuts, dairy, gluten, and other common allergens. Customers with severe allergies should inform our staff before ordering. We are not liable for any allergic reactions that may occur.

15. Gift Cards & Promotions

Gift cards are valid for one year from the date of purchase and cannot be replaced if lost or stolen. Promotions and special offers cannot be combined with other discounts or promotions. We reserve the right to modify or cancel any promotion at any time. Gift cards and promotions cannot be redeemed for cash and are non-refundable.

16. No Warranties

The Services are provided "as is" and "as available", without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Services will be uninterrupted, error free, or that menu items, prices or availability shown online will always be accurate. Nothing in these Terms limits any rights you have under consumer protection law that cannot be waived.

17. Indemnification

You agree to indemnify and hold harmless Miny's Mexican Restaurant and its owners, staff and service providers from any claim, loss or expense arising out of your misuse of the Services, your violation of these Terms, or your violation of the rights of another person.

18. Dispute Resolution

If you have a problem with an order or with the Services, please contact us first. Most issues are resolved quickly and directly, and we ask that you give us 30 days to try before starting formal proceedings. This does not limit your right to bring a claim in small claims court, or to contact a consumer protection agency.

19. Governing Law

These Terms are governed by the laws of the State of Michigan, without regard to its conflict-of-law rules. You and Miny's Mexican Restaurant agree that any dispute arising out of these Terms or your use of the Services will be brought exclusively in the state or federal courts located in Washtenaw County, Michigan, and both parties consent to the jurisdiction of those courts.

20. Severability

If any provision of these Terms is found unenforceable, that provision will be limited or removed to the minimum extent necessary and the remaining provisions will stay in full force.
